DIVORCE
Almost everyone knows someone, whether a family member, friend, co- worker or acquaintance, who has gone through a divorce. Many people have experienced a divorce themselves. As a result, most people have a preconceived notion as to what their rights and obligations are and what they can expect to occur when their divorce is concluded. Unfortunately, many people receive inaccurate information because every case is different. That is why it is important to consult an attorney to find out how the law applies to your situation. There are several types of divorce in the State of Florida and the individual facts and circumstances surrounding each case dictate which type applies.
PARENTAL RESPONSIBILITY
Maintaining a healthy relationship with both parents is vitally important for the development of children; however, for most parents, continuing to parent in a relationship that has broken down is vastly different from parenting in an intact relationship. Florida law promotes positive interaction between children and their parents and the law has recently changed to allow parents to develop a collaborative plan to parent together.
EQUITABLE DISTRIBUTION
Florida law presumes that all assets acquired during a marriage are marital in nature, with some exceptions. During a divorce, the court will try to divide the assets between the parties in an equitable manner. This does not always mean 50/50 and there are circumstances that warrant an unequal distribution.
ALIMONY
There are various types of alimony that a court can award in a divorce case. Whether a party is eligible and, if so, the amount and duration depends on a number of factors the court will consider.
CHILD SUPPORT
Florida law dictates that all parents must provide for their children. Child support is financial support given to one parent for the basic necessities, such as food, clothing and shelter. The amount of child support is based upon the combined net monthly income of the parents and includes costs for daycare and health insurance.
